If you are planning to bridge a watercourse or construct a building within eight metres of a watercourse or culvert you MUST seek the consent of the Lindsey Marsh Drainage Board.

Byelaw 10 states:

"No person without the previous consent of the Board shall erect any building or structure, whether temporary or permanent, or plant any tree, shrub, willow or other similar growth within eight metres of the landward toe of the bank where there is an embankment or wall or within eight metres of the top of the batter where there is no embankment or wall, or where the watercourse is enclosed within eight metres of the enclosing structure."

A Byelaw application form can be obtained from the Board’s offices at Manby.

To assist people within the district the Board has published guidance entitled ‘Policy for Protecting Board Maintained Watercourses and Culverts’, a copy of which can be obtained from the Board’s offices at Manby.

The Land Drainage Act 1991, Section 23(1), states

"No person shall-

(a) erect any mill dam, weir or other like obstruction to the flow of any ordinary watercourse or raise or otherwise alter any such obstruction; or

(b) erect any culvert that would be likely to affect the flow of any ordinary watercourse or alter any culvert in a manner that would be likely to affect any such flow,

without the consent in writing of the drainage board concerned."

An application form can be obtained from the Board’s offices at Manby and this should be completed and returned together with a fee of £50. The application will be considered by the Board’s engineers to ensure that there is no detrimental effect on the drainage system of the district.

Works must not commence before written consent has been received from the Board.
